  • Tip Of The Day

When a debtor tries to avoid paying debts owed to one or more of its creditors by transferring assets to a friend, relative or affiliated business, this can be considered a fraudulent transfer. In Texas, a creditor may recover from the recipient of such a transfer depending on the facts. Courts may void the transfer or make the recipient pay the damages to the creditor. If you are a creditor and think a debtor has transferred assets to avoid repaying a debt, see a qualified lawyer in your jurisdiction.
