As Houston business lawyers, we are sometimes asked if in Texas, a lessee can attach a mechanic’s lien to the leased premises. The contractor will not be able to enforce a lien on the owner’s property unless there is a contract between the contractor and the owner. In Texas, there is no statute authorizing a lien by a contractor of a lessee on the property of the lessor/owner.
